Welcome to the website of the Nick Holappa Foundation (“the Foundation,” “we,” “us”), a nonprofit organization based in Cleveland, Ohio, that funds therapy and research for veterans living with PTSD and other mental-health conditions.
These Terms of Service (“Terms”) govern your use of our website and online services (the “Site”). Please read them with our Privacy Policy. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
In a crisis? This website cannot respond to emergencies. If you or someone you know is in crisis, dial 988 and press 1 for the Veterans Crisis Line, text 838255, or call 911 in an emergency.
You may use the Site if you are at least 13 years old. If you are under 18, you must have a parent or guardian’s permission before you make a donation, sign up for events, or send us personal information. You agree to give accurate information when you contact us or donate.
The Site and everything on it is for general information about the Foundation and its mission. It is not medical, psychological, counseling, legal, tax, or financial advice, and it does not create a doctor-patient, therapist-client, or any other professional relationship.
The Foundation funds therapy and research. We do not provide clinical treatment through this Site. If you are a veteran who needs help, please contact a qualified provider or the Veterans Crisis Line (dial 988, then press 1; text 838255; VeteransCrisisLine.net). Do not rely on the Site, or send us an email or form message, in an emergency.
You agree to use the Site only for lawful and respectful purposes. You will not:
Donations made through the Site are voluntary gifts to support the Foundation’s mission. The Foundation is a nonprofit organization [and is recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, EIN XX-XXXXXXX]. We will send a receipt or acknowledgment for your gift. Whether your gift is tax-deductible depends on your own circumstances, so please talk to your tax adviser.
Donations are processed by a third-party payment provider, and its terms apply to the payment. The Foundation does not store your full card number.
By donating, you confirm that you are authorized to use the payment method and that the amount is correct. Donations are final and non-refundable except where a mistake or unauthorized charge occurred. If that happens, please contact us within 60 days so we can look into it, and we will refund the amount where appropriate.
The Foundation uses donations where they are needed most to carry out its mission, unless you designate a specific purpose that we have accepted in writing. If a restricted purpose later cannot be carried out, we will use the gift for the closest related purpose, as the law allows. Recurring donations continue until you cancel them by contacting us or using your payment provider’s settings.
Unless we say otherwise in writing, you do not receive goods or services in exchange for a donation. Where you do, we will tell you the value so that you can work out the deductible amount.
Information about events, volunteer opportunities, and sponsorship tiers on the Site is for general information and may change. Sign-up for an event or volunteer role does not create employment, and participants may be asked to sign a waiver or consent form. Sponsors receive only the recognition listed in a written sponsorship agreement with the Foundation.
The Site and its text, graphics, logo, name, design, and other materials belong to the Foundation or its licensors and are protected by copyright, trademark, and other laws. You may view the Site and share links to it. You may print or copy a small amount of content for personal, non-commercial, or educational use if you keep our credit and notices. You may not otherwise copy, change, sell, or use our content or our name and logo without written permission.
If you send us a message, story, comment, photo, or other material (“Submissions”), you keep your ownership of it, but you give the Foundation permission to use it to respond to you and to operate the Site. Any other use, such as publishing it, requires your separate written permission. We will not publish a veteran’s name, photo, story, or health information without that person’s written permission. You promise that your Submission is yours to share and does not break anyone’s rights or the law.
The Site may link to websites and services we do not own or control, such as payment processors, social media, government resources, or partner organizations. We do not endorse them and are not responsible for their content, security, or practices. Using them is at your own risk and under their terms.
Our Privacy Policy explains how we collect and use information. By using the Site you agree to the Privacy Policy.
The Site is provided “as is” and “as available.” To the fullest extent the law allows, the Foundation disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Site will be uninterrupted, secure, or free of errors or harmful components, or that information on it is complete or current. Statements about our programs, plans, and results describe our goals and are not guarantees.
To the fullest extent the law allows, the Foundation and its directors, officers, volunteers, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Site, even if we were told such loss was possible. Our total liability for any claim relating to the Site will not exceed $100 or the amount you donated to us in the 12 months before the claim, whichever is greater. Some places do not allow certain limits, so these limits apply only as far as the law permits. Nothing in these Terms limits liability that cannot legally be limited.
You agree to defend and hold harmless the Foundation and its directors, officers, volunteers, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, that arise from your misuse of the Site, your Submissions, or your violation of these Terms or the law.
We may suspend or block access to the Site, remove Submissions, or decline donations at any time and without notice if we believe you have broken these Terms, the law, or the Foundation’s values, or to protect the Foundation or others. The sections that by their nature should continue, such as Sections 6, 9, 10, 11, and 14, survive termination.
We may change, suspend, or discontinue any part of the Site at any time. We may update these Terms from time to time by posting the new version on this page with a new “Last updated” date. If a change is significant, we will give clearer notice. Your continued use of the Site after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us and try in good faith to resolve the matter informally for at least 30 days. Any dispute that is not resolved will be brought in the state or federal courts located in Cuyahoga County, Ohio, and you agree to their jurisdiction and venue, except where the law requires otherwise.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms. We may transfer ours to a successor charitable organization. These Terms and the Privacy Policy are the entire agreement between you and the Foundation about the Site.
